40 new IHC appointments challenged in IHC

Petitioner terms hiring for BPS-2 to BPS-19 posts illegal.

Appointments on 40 administrative posts in the Islamabad High Court (IHC) were challenged in a court on Saturday.


Anila Zishan filed a writ petition with the IHC stating that the appointments made in January 2011 for grade BPS-2 to BPS-19, were illegal.

The petitioner made the law secretary, finance secretary, Pakistan Printing Corporation managing director, IHC registrar, IHC appointing authority and the Accountant General of Pakistan (AGPR) respondents in the case.

The petitioner contended that the appointments were made without proper advertisement or a competitive examination. He further said that the appointments were putting extra burden on the IHC, which has a budget of Rs212 million for the current fiscal year.

The petitioner claimed that the AGPR had also questioned the appointments, which include inductions on deputation as well as direct recruitment. “It wrote to the IHC in April objecting to the appointment of Imtiaz Ahmed as deputy registrar in BPS-19,” said Zishan.


“The actions of the respondents are against the provisions of the constitution, which propagate eradicating discrimination, nepotism and favouritism from society,” Zishan added.

While pointing out the appointment of Saqib Shiraz in BPS-17 as an assistant accounts officer on deputation, the petitioner said that Shiraz was working on scale-4 in Radio Pakistan.

The petition said the recent direct appointments on deputation also defied the criteria which the court had itself laid down.

Earlier, Justice Muhammad Anwar Khan Kasi had disposed of a petition against the appointments of 16 patwaris (revenue officials) in Islamabad Capital Territory (ICT) on deputation.

The court had observed that the vacant posts could only be filled through deputation when ICT advertises them in the media. ICT residents were also barred from applying for the posts.

He prayed the court to accept the petition and to direct the respondents to perform their function in accordance with the law.

He also prayed to declare these appointments null and void.
