CNG stations case: New full bench to decide conflicting judgments

New bench would consist of Justices Gulzar Ahmed, Maqbool Baqar and Ahmed Ali M Sheikh.

KARACHI:

Withdrawing himself from a full bench hearing more than five identical petitions questioning the conversion of residential plot into commercial ones and allowing CNG stations on them, Chief Justice Musheer Alam of the High Court of Sindh ordered on Monday for a new three-member bench to hear and decide the conflicting judgments handed down by two division benches.

The new bench would consist of Justices Gulzar Ahmed, Maqbool Baqar and Ahmed Ali M Sheikh.

Earlier on, a division bench with Chief Justice Musheer Alam, then a judge, and another bench headed by Justice Mujeebullah Siddiqui, rendered conflicting judgments.

The petitions were fixed on Monday before the full bench but owing to his heavy work load, the CJ withdrew and formed a new bench to decide the controversy as soon as possible as these petitions have been pending for years.

The petitioners challenged the conversion of residential plots into commercial ones and the decision to subsequently permit CNG stations on them as they were considered hazardous by the residents.
