Olivier Martinez reportedly left a custody hearing involving his ex-wife, Halle Berry, on October 20 before returning to the courtroom approximately five minutes later, Page Six reported.
A source disputed reports that he had stormed out, saying the departure was a bathroom break.
The proceedings concern Martinez's allegations that Berry physically abused their 13-year-old son, Maceo. Berry has denied the accusations, with her attorney, Marina Beck, describing the filing as "entirely meritless and deliberately misleading."
Both actors, who are 60, attended the second day of the hearing separately. Berry testified on Tuesday, while school staff member Jon Hay was also scheduled to give evidence. Martinez's lawyer, Patrick Baghdaserians, has denied allegations that his client coached their son.
Maceo testified for nearly four hours on October 19. His testimony was limited to the request for a domestic violence restraining order and remains sealed, according to Entertainment Weekly.
The dispute centres on a September 26 incident at Berry's home. Martinez alleges that Maceo described an assault during a telephone conversation.
Berry has disputed his account and said she was "absolutely blindsided" by the legal filing, according to a declaration obtained by Us Weekly.
A judge granted Martinez a temporary restraining order on October 1 covering him and Maceo. The order restricted Berry's parenting time but allowed daytime visits to continue while the case is considered.
Martinez is seeking sole custody of their son, while Berry wants to restore the previous 50-50 parenting arrangement established when their divorce was finalised in 2023.
Berry's daughter, 18-year-old Nahla Aubry, also submitted a declaration describing her experience living with her mother and brother.
"I never observed anything abusive about her parenting," Nahla wrote, according to PEOPLE.
Berry has also identified her fiancé, Van Hunt, as a witness to the disputed incident. The custody proceedings remain ongoing, with both parents presenting differing accounts of the events and their son's involvement.
