Halle Berry seeks return to 50/50 custody of son Maceo amid dispute with Olivier Martinez

Halle Berry has asked a court to restore her previous 50/50 custody arrangement for her 12 year old son Maceo, whom she shares with former husband Olivier Martinez. The actress also wants her previous authority to make tie breaking decisions reinstated and is asking Martinez to attend court ordered therapy sessions.
According to court documents obtained by PEOPLE and published October 5, Berry claimed Maceo sometimes returns from Martinez’s custody periods angry and combative. She alleged that these difficulties can last for several days, particularly after longer periods with his father.
Berry further claimed Martinez has influenced Maceo during disagreements over issues involving school, football and therapy. She alleged that he has also resisted efforts involving Maceo’s psychological and educational needs. These claims remain allegations contained in Berry’s court filing and have not been established as facts.
The filing comes after Martinez requested sole custody and alleged that Berry physically abused their son. Martinez claimed an incident occurred on September 26, when he alleged Berry choked Maceo. Berry’s latest filing does not directly address those abuse allegations.
On October 1, a Los Angeles County judge granted Martinez a temporary restraining order covering himself and Maceo. The order temporarily changed Berry’s visitation schedule while allowing continued contact between mother and son. The judge declined to require sobriety monitoring, citing insufficient information.
Berry and Martinez finalised their divorce in 2023 after filing in 2015. Their agreement provided for joint legal custody, with Berry paying Martinez $8,000 a month in child support. They later agreed to co parenting therapy in 2024, although the sessions became contentious.
The latest filings mark another escalation in the former couple’s long running custody dispute, with both parents presenting conflicting accounts to the court about what they believe is best for Maceo.
