Matt Kalil plans appeal after lawsuit against ex-wife Haley Baylee is dismissed

Former NFL player Matt Kalil plans to appeal after a judge dismissed his lawsuit against his ex-wife, Haley Baylee, over comments she made about their marriage and sex life.

“We are not going to comment at this time other than to say we intend to appeal this decision,” Kalil’s attorney, Ryan Saba of Rosen Saba LLP, told Page Six.

A judge ruled on Thursday that Baylee’s comments were protected because she was discussing her own life, marriage and divorce, which the court found to be matters of legitimate public concern.

Baylee, 34, said she was “so relieved this is over” in a statement to TMZ and expressed hope that the ruling would encourage women to speak openly about their experiences.

Her attorney, Matthew Bialick, said they were “very pleased” that the court dismissed every count against her.

The legal dispute began after Baylee discussed her nearly seven-year marriage to Kalil, 37, during a November 2025 livestream with internet personality Marlon Garcia.

During the conversation, she spoke about their sex life and claimed intercourse with her then-husband would leave her “in tears”.

Baylee also compared Kalil’s penis to “two Coke cans, maybe even a third” and claimed it was “like .01 percent of the population.”

“We’ve tried, impossible unless you’re going to be in tears,” she continued.

Kalil filed the lawsuit in January, accusing Baylee of invasion of privacy and unjust enrichment. He alleged that her comments led to widespread ridicule and unwanted attention for him and his family.

He also claimed Baylee financially benefited from renewed attention surrounding the livestream and said his new wife, Keilani Asmus, received disturbing messages.

Baylee asked the court to dismiss the case, arguing that her comments were part of a truthful, autobiographical account of her own marriage and experiences.

Kalil’s legal team argued that she had no right to disclose private marital and sexual details publicly for financial gain.
