Court hears texts discussing pregnancy and abortion as D4vd's preliminary hearing continues in murder case

A Los Angeles court has heard text messages discussing pregnancy and abortion as the preliminary hearing continues for singer D4vd, who is charged with the murder of 14-year-old Celeste Rivas Hernandez.

David Anthony Burke, known professionally as D4vd, has pleaded not guilty to first-degree murder, continuous sexual abuse of a child under 14 and unlawful mutilation of human remains.

Prosecutors allege he killed Hernandez after she threatened to expose what they describe as their illegal sexual relationship.

During the fourth day of testimony, prosecutors presented text messages exchanged between Burke and Hernandez in 2023 and 2024, when she was 13 years old.

According to testimony from LAPD Detective Corey Farell, the messages discussed pregnancy, the Plan B emergency contraceptive pill and abortion "many times."

In one January 2024 exchange, Burke apologised for putting Hernandez "through this." According to Detective Farell, Hernandez replied, "neither of us are capable of watching and taking care of the baby. it's for the best no?"

Burke also asked, "my mother always told me to ask… it is mine right?" Hernandez responded, "of course its yours David."

Prosecutors also highlighted messages from June 2024 in which Hernandez expressed concern that "the first abortion didn't work." Burke allegedly replied, "Let's let this abortion be the last one til we have the real one."

The court also heard an undated message, reportedly sent months later, in which Hernandez allegedly told Burke, "I killed my first kid for you."

According to prosecutors, Hernandez later threatened to reveal the relationship, which they allege placed Burke's music career at risk.

Hernandez was last seen on April 23 2025 after prosecutors say Burke arranged an Uber to take her to his rented Hollywood Hills home, two days before the release of his debut album, Withered.

Her dismembered remains were discovered on September 8 in the trunk of Burke's impounded Tesla, one day after what would have been her 15th birthday.

Earlier testimony alleged Hernandez's severed hand was missing two fingers that bore a tattoo of Burke's name.

Investigators also testified Burke allegedly used aliases to purchase chainsaws, an inflatable pool, a shovel, a fireproof mat and a burn box, described in court as "a mini crematorium-type" device.

Burke's legal team has denied the allegations, stating, "The actual evidence in this case will show that David Burke did not murder Celeste Rivas Hernandez and he was not the cause of her death. We will vigorously defend David's innocence."

At the conclusion of the preliminary hearing, a judge will determine whether there is sufficient evidence for the case to proceed to trial.
