M-Tag: IHC seeks response from ministry

The Islamabad High Court (IHC) has sought replies from the Ministry of Communications and the National Highway Authority (NHA) in a petition challenging the imposition of a 50% surcharge on vehicles using motorways without an M-Tag or with insufficient M-Tag balance.

Chief Justice Sardar Muhammad Sarfraz Dogar issued a two-page written order while hearing a petition filed by the Judicial Activism Panel. According to the order, the petitioner's counsel argued that the NHA had issued a notification on June 3, 2025, imposing the additional charge on motorists.

The counsel contended that the notification had been issued under Section 10(2)(vii) of the NHA Act, 1991, but maintained that the provision did not empower the NHA to impose such a surcharge.

The petition further argued that the notification violated the NHA Act and the fundamental rights of citizens. In its order, the court directed the Ministry of Communications and the NHA to submit their reports and para-wise comments within 15 days.

The court also ordered that a copy of the petition be provided to the law officer, who would ensure compliance with the court's directions.

The law officer was further directed to assist the court at the next hearing. The court issued notices to the respondents and sought their replies in the matter.
