Court denies Tate Paul restraining order against Taylor Frankie Paul
A Utah judge found no evidence of immediate and irreparable harm while custody proceedings continue

Taylor Frankie Paul has secured an early legal victory after a Utah court denied a request from her former husband, Tate Paul, for a temporary restraining order. The ruling comes amid an ongoing custody dispute involving the former couple's two children and marks the latest development in a highly publicised legal battle.
According to court documents obtained by Us Weekly, the judge determined there was insufficient evidence to justify granting an emergency restraining order. The filing stated that many of Tate Paul's allegations relied on inadmissible hearsay and lacked independent corroboration. The court also noted that while some of the concerns raised could understandably create anxiety, they did not demonstrate the immediate and irreparable harm required under Utah law to issue emergency relief.
The ruling pointed to a recent period in June 2026 when Tate Paul reportedly left the children in Taylor Frankie Paul's care while he travelled to Iceland. The court found this inconsistent with claims that the children were facing an urgent danger requiring immediate intervention.
Tate Paul originally filed both the request for a temporary restraining order and a petition seeking to modify the former couple's divorce and custody agreement. The pair were married from 2016 until their divorce in 2022 and share daughter Indy, aged eight, and son Ocean, aged six.
The latest court decision does not end the broader custody proceedings, which remain active. Instead, it means the requested emergency order will not take effect while the legal process continues. The judge indicated that ongoing concerns relating to the children's wellbeing would need to be addressed through standard custody proceedings rather than emergency action.
The dispute follows a series of legal issues involving Taylor Frankie Paul's relationship with former partner Dakota Mortensen, with whom she shares two year old son Ever. Earlier this year, authorities confirmed there was an open domestic assault investigation following an alleged altercation between the former couple. Police stated that allegations had been made by both parties.
The case also follows a widely reported February 2023 incident in which Taylor Frankie Paul was arrested after an alleged domestic dispute. She later pleaded guilty to felony aggravated assault in August 2023 under a plea agreement, while other charges were dismissed. Since then, both Taylor Frankie Paul and Mortensen have obtained temporary protective orders against each other, with each denying the allegations made by the other.
In June 2026, another judge recommended that Taylor Frankie Paul no longer be required to have supervised visits with Ever. Under the updated arrangement, she is permitted parenting time on alternate weekends and one midweek day while custody proceedings continue.
Taylor Frankie Paul and Dakota Mortensen are scheduled to return to court on July 8 for a further custody hearing concerning Ever. Meanwhile, the separate custody dispute between Taylor Frankie Paul and Tate Paul remains ongoing following the denial of the temporary restraining order. The latest ruling allows the existing custody arrangements to remain in place while both parties continue presenting evidence through the normal legal process.
