Timothy Busfield seeks to dismiss indictment as new court filing emerges

Actor Timothy Busfield has asked a New Mexico judge to dismiss the grand jury indictment filed against him, arguing that prosecutors failed to present key evidence during the proceedings.
According to court documents cited by TMZ, Busfield claims the prosecution did not provide the grand jury with information that he believes supports his defence. The actor alleges that investigators and prosecutors were aware of evidence that could have been favourable to him, including the results of an independent investigation and witness statements, but chose not to present that information during the indictment process.
Busfield reportedly argues that the prosecution’s handling of the case resulted in an incomplete presentation of the facts. He also claims that when he appeared before the grand jury to testify on his own behalf, prosecutors treated the proceeding as an adversarial cross-examination rather than a fair opportunity to present his account.
The legal filing comes months after Busfield surrendered to authorities in New Mexico following the issuance of an arrest warrant. In February, a grand jury indicted the actor on child sexual abuse charges. Busfield has denied all allegations against him.
The actor’s wife, actress Melissa Gilbert, has publicly maintained his innocence since the case became public. Busfield’s legal team is now seeking to have the indictment dismissed, arguing that the grand jury process was flawed and that relevant evidence was not adequately considered.
The court has not yet ruled on the request. If the motion is denied, the case is expected to proceed through the New Mexico legal system.
The latest filing marks another development in the ongoing legal proceedings, which continue to draw attention from both the entertainment industry and the public.
