Property rights for the diaspora
For millions of overseas Pakistanis, investing in a home back home has long been both an emotional aspiration and a legal nightmare. Tales of fraudulent transfer, forged powers of attorney, illegal occupations and endlessly delayed court proceedings have discouraged many expatriates from investing their hard-earned savings in Pakistan. Against this backdrop, the recent ruling by the Lahore High Court expanding the jurisdiction of special property courts to include overseas Pakistanis is a welcome development.
In a landmark judgment authored by Justice Anwaar Hussain, the court clarified that the special courts established under the Punjab Establishment of Special Courts (Overseas Pakistanis Property) Act, 2025 can now hear the entire spectrum of property-related cases involving overseas Pakistanis, including inheritance disputes, partition matters and others. This may appear to be a technical legal clarification but for overseas Pakistanis, the judgment addresses one of the biggest barrier which is lack of confidence in the legal protection of their assets. The special courts were created precisely to address concerns by providing a faster and more focused judicial mechanism. However, confusion regarding their jurisdiction had already started undermining their effectiveness. Some courts had narrowly interpreted the law, sending cases back to ordinary civil courts, thereby recreating the very delays the legislation sought to eliminate. The LHC has now decisively closed that loophole. The judgment is also important because it reinforces the idea that overseas Pakistanis are not merely remittance senders but stakeholders in Pakistan's economic future.
Pakistan's relationship with its diaspora cannot remain transactional. The LHC ruling is therefore a step towards reassuring overseas Pakistanis that the country values their connection and is willing to protect their rights. If followed by effective implementation and institutional integrity, it could encourage greater investment and a stronger partnership.
