Kilmer, who died on April 1, 2025, is set to appear in the upcoming project As Deep As the Grave through AI technology, with the support of his family. The film reportedly reflects a project the actor had hoped to complete before his health declined due to throat cancer.

The announcement, first reported by Variety, has generated criticism from some figures in the industry. Actor Jackson Rathbone publicly questioned the decision on social media, raising concerns about the ethical implications of using AI to recreate a performer after their death.

“Hey SAG-AFTRA, about that strike we had, you owe us an explanation. Is this okay? What the hell?” he wrote. He also directed criticism towards Kilmer’s daughter, Mercedes Kilmer, stating, “Hey Mercedes, I’m sorry for your loss, but this move raises the question: Are you sorry for your loss? Or are you capitalizing on your father’s death for your own financial gain?”

Rathbone added, “This is truly the most disgusting thing I have ever seen. Go to hell, you are all disgusting.”

The use of AI in film production has become an increasingly discussed issue, particularly following industry strikes that addressed concerns around digital likeness and consent. Supporters argue such technology can preserve artistic legacies, especially when projects were left unfinished, while critics warn it raises complex moral and legal questions.

In this case, Kilmer’s family has endorsed the project, framing it as a way to fulfil his creative intentions.
