Cardi B’s reported divorce from Offset has not yet been legally finalized, a fact that could carry significant legal implications now that she has had a child with Stefon Diggs.

Under Georgia law, the state where this all may play out, being married at the time of a child’s birth creates a strong legal presumption that the husband is the child’s father, regardless of biology.

Georgia’s statutes define a “legal father” to include a man who was married to the child’s mother when the child was born, unless a court has definitively ruled otherwise.

This means that Offset could still be considered the child’s legal father, even though Diggs is believed to be the biological parent.

Overturning this presumption isn’t easy: the law requires “clear and convincing” evidence to rebut it.

At the same time, Stefon Diggs has a legal pathway forward. He can file a legitimation petition in Georgia’s courts, which would allow him to be legally recognized as the father.

If the court grants that petition, he could obtain rights typically reserved for married fathers, including custody, visitation, and inheritance.

For Cardi, until her divorce is fully resolved and any paternity challenge is settled, the legal daddy to her newest child might still be Offset, at least on paper.
