Woman secures bail in drug case
The Islamabad High Court division bench comprising Justice Khadim Hussain Soomro and Justice Muhammad Asif Khan has granted bail and ordered the release of a woman arrested with her six-month-old daughter in a case involving 12 kilograms of narcotics.
Advocate Supreme Court Shan Zeb Khan argued that the accused, Samina Bibi, was taken into custody by the Anti-Narcotics Force from a public transport minibus in which 12 kilograms of cannabis were recovered.
However, nothing was found in her personal possession.
He contended that narcotics recovered as unclaimed from a vehicle cannot be attributed to any individual unless found in direct possession.
He further argued that the woman is a housewife, mother of an infant, and has never been arrested or involved in any previous case.
The High Court granted bail on the grounds that the narcotics were unclaimed and that the woman had a six-month-old baby with her.
The court ordered her release upon submission of surety bonds worth Rs100,000.
In addition, session courts acquitted five accused, including Adam Khan, Fawad Ahmed, Rustam Khan, Fauzia Begum, and Rozina Akhtar, in three separate drug supply cases.
The court ruled that the cases were based on false witnesses and unreliable forensic reports.
The court observed that narcotics or prohibited substances must be recovered from an accused's possession and that no citizen can be implicated merely on suspicion or unclaimed recoveries.
