Diddy’s legal team pushes for bail ahead of sentencing

Sean “Diddy” Combs is seeking release from jail ahead of his October 3 sentencing, with his legal team arguing that his conviction under the Mann Act does not warrant pre-sentencing detention.
According to court documents obtained by TMZ, attorneys Marc Agnifilo and Teny Geragos submitted a new bail proposal to U.S. District Judge Arun Subramanian, emphasizing Combs’ nonviolent record in recent years and what they describe as the consensual nature of the conduct in question.
Diddy was found guilty of two counts under the Mann Act, which prohibits the transportation of individuals across state lines for illicit sexual activity. His legal team argues that his case is unusual, asserting he is the only person currently incarcerated for hiring adult male escorts to engage in sexual activity with his long-term girlfriend as part of a consensual swinger lifestyle. They further noted that the escorts were not minors and Combs did not engage in sexual acts with them himself.
The defense contends that societal views on sex have significantly evolved since the Mann Act was enacted in 1910. They also downplayed claims of violent behavior, acknowledging a single 2024 altercation involving a woman referred to as "Jane," which they claim was provoked. While video evidence of a 2016 assault involving singer Cassie was presented at trial, Combs’ lawyers argue he has been mostly nonviolent since 2018.
The proposed bail package includes a $50 million bond secured by Combs’ Florida estate, limited travel restrictions, passport surrender, and monitoring under the U.S. Pretrial Services Agency. Additional conditions offered include home detention and mental health or substance abuse treatment.
Judge Subramanian has not yet ruled on the request. Prosecutors previously opposed bail, citing concerns over Combs’ past behavior and risk to the community.
