‘Every case need not be sent to constitutional bench’
The Supreme Court on Monday disposed of a case pertaining to the overbilling by utilities, because a review plea against a previous decision was still pending.
The matter was heard by a two-member bench, comprising Justice Mansoor Ali Shah and Justice Aqeel Abbasi.
The lawyer said that after the 26th Constitutional Amendment – which allowed the creation of the constitutional bench – this case would now go to that bench. Justice Shah observed that not every matter should be sent to the constitutional bench, some cases should be left for the regular benches.
Later, the bench disposed of the case. The court declared that the review against the decision was already pending in the case.
