The prosecutor general of Punjab has released guidelines to ensure the protection of the identity of rape victims.
The guidelines stress the need to safeguard the identities of victims in accordance with Section 376-A of the Pakistan Penal Code (PPC).
The directive issued to the inspector general of police (IGP) and other relevant authorities outlines the severe legal consequences associated with disclosing any information that may reveal a victim's identity in cases of sexual offences.
Under Section 376-A, it is strictly prohibited to publish any details that could identify victims of crimes such as rape and sexual assault, with violations potentially resulting in up to three years of imprisonment and additional fines.
The guidelines specify that disclosing a victim's name, address, or any identifying detail is punishable by law unless there is written consent from the victim, their legal guardian (in cases involving deceased victims, minors, or individuals of unsound mind), a court order, or an investigating police officer acting in good faith. Notably, judicial judgments published in legal journals are exempt from prosecution under the provision.
In light of recent incidents, the prosecutor general has urged the IGP to enforce the guidelines across all police stations and investigation units. Additionally, the communication calls upon the Pakistan Electronic Media Regulatory Authority (PEMRA), public relations departments, and medico-legal offices to take necessary steps to ensure compliance.
