Constitutional amendment by Parliament cannot be challenged in court: Law minister

Tarar emphasised that under Article 239 of the Constitution, Parliament holds the authority to pass any law

Law Minister Azam Nazeer Tarar stated on Thursday that any legal challenge to the 26th constitutional amendment would be referred to a constitutional bench.

Speaking to private news channel, he emphasised that under Article 239 of the Constitution, Parliament holds the authority to pass any law, and no constitutional amendment made by Parliament can be challenged in court.

He pointed out that the original 1973 Constitution granted the power of judicial appointments to the President.

"Later, through a judicial decision, the judiciary increased its role, and then the 19th amendment further altered this process, compromising Parliament’s authority under pressure," Tarar said.

The minister reiterated that any challenge to the 26th amendment would go to a constitutional bench. He also mentioned that even if PTI had won specific seats, it would not have increased their representation in the parliamentary committee.
