PHC returns K-P CM disqualification petition

The Registrar Office of the Peshawar High Court has returned a petition seeking disqualification of Khyber-Pakhtunkhwa Chief Minister Ali Amin Gandapur on technical grounds.

This petition had previously been returned with objections as well. The petition filed by Advocate Azizuddin Kakakhel contended that under election laws and the Constitution, the Chief Minister cannot use government resources for political purposes, while K-P CM Gandapur used government resources for rallies.

Furthermore, it was also mentioned in the petition that the chief minister led an attack on the federal government, which is alarming. The petition maintained that the cases were filed against Gandapur for using state resources. The petition requested the court to disqualify the K-P CM under Article 62 and bar him from performing his duties.

The PHC registrar returned the petition again on technical grounds, stating a procedure is mentioned in the Constitution for the removal of the chief minister thus the Peshawar High Court is not the right forum for filing such petition.
