APC urges SC to review Sani case ruling

Fazl says govt should file references against three apex court judges

ISLAMABAD:

An all parties conference (APC) organised by the World Council of Tahafuz-e-Khatm-e-Nabuwabt, on the law for the protection of the sanctity of the holy Prophet (PBUH) on Tuesday demanded of the Supreme Court chief justice to rectify the court ruling in Mubarak Sani case through a suo motu notice.

The APC, chaired by Jamiat Ulema-e-Islam-Fazl (JUI-F) chief Maulana Fazlur Rehman, said that the government should file references against the three judges sitting on the bench that gave the ruling in the Mubarak Sani case, otherwise, the APC would file the references.

The APC was also attended by Liaquat Baloch, Dr Abul Khair Zubair, Maulana Hanif Jalandhri, Maulana Abdul Ghafoor Haidari and others. While issuing the APC declaration, Fazl said that they would announce a plan of action on the Supreme Court ruling at the Minar-e-Pakistan on September 7.

The federal government should file a reference against the three judges in the Mubarak Sani case, the APC declaration said. Otherwise, he added, the parties in the APC would file a reference against the chief justice and two other judges.

The APC made it clear that judges were bound by the Constitution and Islam. Expressing its serious concern the APC noted that settled religious points were being deliberately raised. "The APC rejects attacks on Pakistan's Islamic identity. Foreign interference in Pakistan should end."

Fazl said that the Supreme Court ruling in Mubarak Sani case had facilitated the Ahmadis. The Supreme Court should revise its decision through a suo motu notice and remove the ambiguities surrounding its decision.
