Madonna is being sued by a fan who claims she deceived concertgoers by not starting her shows on time and not disclosing the true start time. The fan, Justen Lipeles, filed a class action lawsuit in California against Madonna and her promoter Live Nation.

The lawsuit, as obtained by PEOPLE, claims that Madonna and Live Nation failed to inform ticket buyers that the singer's shows would not start on schedule. Instead, concerts began after 10 p.m. The fan also alleges that Madonna lip-synced much of her performance and maintained a hot and uncomfortable temperature during the show.

The lawsuit also accuses Madonna of featuring topless women simulating sexual acts on stage, which the fan claims was not disclosed to ticket buyers.

Madonna has been accused of having a sex-positive environment in her shows, which have included erotic dancing and lap dances.

The lawsuit seeks unspecified damages for breach of contract, emotional distress, and unfair competition.

This is not the first time Madonna has been sued over her concert schedule. In January, two fans sued her for starting a concert late at Brooklyn's Barclays Center, claiming "false advertising."
