PHC shields Qaisar from arrests

Petitioner's lawyer informs court of concern regarding Qaisar’s re-arrest after bail is granted

PESHAWAR:

The Peshawar High Court (PHC) has issued an order safeguarding former National Assembly Speaker Asad Qaisar and ex-MNA Mujahid Ali Khan from arrest in any ongoing cases against them.

The case was heard by a two-member bench, comprising Chief Justice Muhammad Ibrahim Khan and Justice Ishtiaq Ibrahim.

The petitioner had sought information about all cases registered against Asad Qaisar. During the proceedings, the petitioner’s lawyer, Sher Afzal Marwat, informed the court about a concerning pattern where Asad Qaisar was being arrested in new cases each time bail was granted by the court.

He pointed out that the government had previously provided a list of cases.

Justice Ishtiaq directed questions to the Additional Advocate General Nisar Khan, inquiring whether he had served as AAG during the PTI government. Nisar explained that he held the position during that time but resigned, later being reappointed by the caretaker government.

In response, the court summoned Advocate General Amir Javed. Upon appearing, Javed requested time to prepare answers to the court’s queries. Sher Afzal Marwat highlighted that there were 11 court verdicts demonstrating that if a person was arrested in one case, they were automatically considered arrested in all related cases.
