Bandial’s move that irked Justice Masood

Justice Sardar Tariq Masood had taken strong exception to a move by then chief justice of Pakistan Umar Ata Bandial when he asked him “what to do” about a complaint against the former.

Justice Bandial had completed his term as the chief justice of Pakistan on Sept 16. Justice Qazi Faez Isa was administered the oath as the 29th chief justice of Pakistan by President Arif Alvi on Sept 17.

According to details, on Sept 5, Justice Bandial had called up Justice Masood over a complaint by Amina Malik against the latter, asking him what to do about it.

The next day, Justice Masood expressed his displeasure over Justice Bandial’s move, saying that he should have sent the case to the Supreme Judicial Council.

Justice Masood sent a copy of the letter written to then chief justice Bandial to the SJC members also.
According to sources, the letter written by Justice Masood stated that Justice Bandial asked him what to do about the complaint by Amina Malik.

“It is not appropriate to talk to me regarding a complaint against me. Instead of talking to me, it would have been better that the complaint was placed before the Supreme Judicial Council.”

Justice Masood’s letter stated, “I have full confidence in the Supreme Judicial Council that it will decide according to the Constitution and the law.”

New questions are also being raised over the complaint sent to the SJC against Justice Masood whether it is a counter blast?

The complaint against Justice Masood came at a time when he was entrusted with the responsibility of reviewing the complaints against Justice Mazahar Ali Akbar Naqvi. Justice Masood is expected to give his legal opinion on the complaints against Justice Naqvi in the current judicial week.
