CII suggests special courts to punish violent mob

Forum opposes apex court judgment on drama serial Jalan

The Council of Islamic Ideology (CII) observed on Wednesday that any mob attacks were against the injunctions of Sharia and provisions of the Constitution and suggested special courts for the trial of those involved in violence.

In a meeting, the CII proposed the plantation of such trees, which had been mentioned in the Quran and the Hadiths of Prophet (peace be upon him) during the tree-plantation campaigns in the country.

The CII expressed deep regret over the events that took place in the recent past, in which crowds tried to take the law into their hands. It said that CII had always adopted a clear position regarding such incidents.

“Only the state has the authority to award punishment after judicial investigation of the incidents. The mob is not allowed to take the law into their hands and kill a human being. This type of act is totally against the Sharia and the Constitution,” it said.

The CII said that the causes and motivations of such incidents, and suggestions for their remedy and solution were discussed in the meeting on December 20, 2021 in the context of the Sialkot tragedy – the lynching of a Sri Lankan national.

“The council has suggested special courts to hear and decide as soon as possible to prevent such incidents so that any form of public agitation can be dealt with,” the CII added.

The CII had also endorsed the declaration of the ‘Message of Pakistan’, in which scholars of all schools of thought had issued the edict that only the state had the authority to declare and punish any armed action.

Meanwhile, the CII expressed reservations over the definitions of obscenity, sexual orientation and tolerance in the recent decision of a two-member bench of the Supreme Court on April 12, 2023 in a case pertaining to drama serial ‘Jalan’.

The CII noted that such decisions were neither compatible with the spirit of Sharia, nor the Article 19 of the Constitution. It expressed apprehension that such remarks in the judgments would lead to increase in obscene dramas on the media.

The CII decided to write a letter to the registrar of the Supreme Court to convey its concerns to the superior judiciary. It warned that destruction of relationships, would have “very negative effects on our society”.

The CII applauded Senior-most judge of the Supreme Court, Justice Qazi Faiz Isa’s recent judgment on women’s inheritance that called for punishing those who deprived sisters and wives of their share in the property.

The forum welcomed a recent decision of the Federal Sharia Court (FSC) on the Transgender Act and said that the decision was in line with the recommendations of the CII.

The meeting underscored the importance of the tree-plantation campaigns across the country to mitigate the adverse impacts of the climate change. The CII suggested the introduction of ‘Gulshan-e-Quran’ at every district and tehsil level.

In the ‘Gulshan-e-Quran’ such plants and trees should be planted which were mentioned in the holy Quran and Hadiths of the Prophet (PBUH). This campaign, it added, would gain public acceptance and help fight climate change to a large extent.
