Court trashes Rashid’s plea against order to vacate Lal Haveli

Ex-home minister challenges verdict; hearing expected tomorrow

A civil judge has dismissed the petition filed by former interior minister Sheikh Rashid Ahmed, seeking a permanent injunction against the forced evacuation of his residence, Lal Haveli, by the Evacuee Trust Property Board (ETPB).

The court of Civil Judge Naveed Akhtar declared that the case is already sub-judice and the court cannot stop any legal institution from acting under the law and Constitution.

The court directed the counsel for both parties to appear on the next scheduled date of the hearing.

On the other hand, the former interior minister has challenged the civil judge's decision in the court of Additional District and Sessions Judge Rawalpindi, which is expected to be taken up for hearing on Monday [tomorrow].

On Saturday, Rashid’s counsel Advocate Sardar Abdul Razaq filed a petition on his behalf in which he adopted the stance that the Lal Haveli case was pending adjudication while the ETPB wanted to get it vacated by force, ignoring the fact that the matter pertaining to the evacuee property was sub-judice.

“The department has sent a letter to the deputy commissioner and demanded the assistance of police and Rangers,” the petition upheld, seeking a stay in the matter. The court had reserved its decision after completing the hearing and while pronouncing its judgment dismissed the petition.
