SHC moved against disappearance of ex-MPA
The Sindh High Court (SHC) has issued notices to senior government officials and heads of law enforcement agencies on a petition recovery of former MPA Nisar Panhwar, who moved the court for lifting of the ban on the founder of Muttahida Qaumi Movement (MQM).
A two-judge bench of the SHC, headed by Justice KK Agha, issued the notices while hearing the petition filed by Mohsin Panhwar, son of Nisar Panhwar, through his lawyer Khalid Mumtaz Advocate.
In the petition, Mohsin Panhwar claimed that his father was arrested from his house by the law enforcement agencies on the night of August 30. He requested the court direction to the authorities to immediately release Panhwar.
The court issued notices to the Sindh Home Department, IG Police and DG Rangers Sindh and other officials while ordering them to submit their reply by October 13.
In his petition, Mohsin has stated that his father's whereabouts remain unknown since his arrest on August 30.
Advocate Mumtaz informed the court about Panhwar's disappearance during the hearing of his client's petition seeking lifting of the ban on the MQM founder on Wednesday. He requested the court to take suo motu notice.
Meanwhile, the SHC suspended a Sessions Court judgment regarding a medico-legal examination of the under-age girl who had travelled to Lahore to marry a young man of her own choice.
While issuing the injunction, a single-judge bench of the SHC comprising Justice Salahuddin Panhwar directed on Thursday that the medico-legal examination should not be conducted until further orders.
Justice Panhwar issued these orders while hearing the bail applications of the accused as well as the appeal against the sessions court's order for a medico-legal examination of the alleged abductee. The counsel for the petitioner sought SHC injunction against the sessions court judgment.
