Buzdar’s resignation challenged in Lahore High Court
A writ petition challenging the resignation of Punjab Chief Minister Sardar Usman Buzdar has been filed in the Lahore High Court.
Petitioner M Tanveer argued that former governor Muhammad Sarwar had violated the Constitution by accepting the resignation.
The petition filed through Advocate Nadeem Sarwar requested the court that the action of the former governor be declared illegal because he had accepted the resignation in which he had not been addressed.
He questioned the acceptance by the governor of the resignation that was addressed to the then prime minister Imran Khan.
The petitioner prayed the court that the election and actions taken by PML-N leader Hamza Shehbaz Sharif be declared unlawful and he be restrained from acting as the chief minister till the disposal of the petition.
The petitioner made respondents the province through the law secretary, Usman Buzdar, Hamza Shehbaz, Governor Umar Cheema, former governor Chaudhry Muhammad Sarwar and Pakistan Tehreek-e-Insaf chairman Imran Khan.
The counsel raised the point in the petition that the governor had violated Article 130(8) of the Constitution as the resignation had not addressed to him. After acceptance of the resignation, Hamza Shehbaz was elected as chief minister on the vacant seat.
It is trite law that when the base of any action or order is illegal then the whole superstructure built thereupon cannot be sustained, the counsel added.
