The Islamabad High Court (IHC) on Thursday issued notices to the Election Commission of Pakistan (ECP) and the ministry of law on petitions against the issuance of the Islamabad Local Government Ordinance, 2021, and sought a reply by February 7.
“The new local government system has been introduced through an ordinance in the presence of the local government act. It would be decided after hearing the ECP as to whether or not a stay on the local government ordinance could be granted,” IHC judge Mohsin Akhtar Kayani made these remarks while hearing petitions filed by the CDA trade union and the officers’ association, challenging the Islamabad local government ordinance.
On behalf of the petitioners, advocate Qazi Adil and Kashif Ali Malik appeared in court.
“Ordinance is only emergency legislation. Which emergency was there for introducing the local bodies’ ordinance? The ministry of law should also answer why the local government act was repealed through an ordinance,” the judge observed and inquired about the current stage of local bodies elections in Islamabad.
