PHC issues notice to govt over amendments to civil procedure code

PESHAWAR:

The Khyber-Pakhtunkhwa Bar Association (K-PBA) has extended their protest against the amendments to civil procedure code until October 27.

The K-PBA had already announced a protest from October 17 to October 21 but it failed to convince the provincial government.

As a result, the bar association has now decided to extend it’s protest.

A statement issued by the K-PBA said that the tehsil and district bar associations should also present their suggestions on amendments to the civil procedure code and to chalk out future plans.

The government had announced that it will further amend the amendments since July 15 but has continued to drag its feet on it, worrying the lawyer’s fraternity and applicants.

The PHC on Wednesday sought replies from the provincial government over the amendments made to the civil procedure code.

A two-member bench of the PHC, comprising Justice Muhammad Nasir Mehfooz and Justice Arshad Ali, took up a writ petition filed against the amendments.

The petitioner contended that the amendments are akin to an economic assault on the lawyer's fraternity while amendments to section 26C will raise many legal complications.

After hearing initial arguments, the bench issued notices to the government and directed them to file a reply.
