Police swap complainant, co-accused names in FIR
A woman went on to assist her accomplice get bail through a dishonest affidavit
LAHORE:
Lahore High Court (LHC) on Friday took up an odd case wherein the co-accused woman in connivance with police officials got herself converted into a complainant whereas the genuine complainant of the first information report (FIR) was turned into the accused.
Later, the co-accused now converted to a complainant was able to get a bail order for the actual prime accused of the case (her accomplice) by deceiving the court.
“It is astonishing that an FIR was registered by complainant Orangzeb against the accused Tahir Shah, who was union council (UC) secretary in Gujranwala, for allegedly tampering the divorce record on the direction of the co-accused Tasneem Akhtar, however, the co-accused woman upon whose direction the record was tampered, became the complainant of the same FIR, while the genuine complainant Orangzeb was made the accused,” Advocate Muhammad Younas Choudhary, the petitioner’s counsel, contested in the LHC.
Interestingly, the first post-arrest bail of the prime accused Tahir Shah had been dismissed by the Anti-Corruption Court and later by the LHC.
Cabinet approves Mushtaq Mehar as new Sindh police chief
Then once again post-arrest bail was filed in the Anti-Corruption Court which was then allowed on the basis of compromise. This time the co-accused woman in her affidavit submitted to the Anti-Corruption Court falsely presented herself as the complainant.
She stated that there was a misunderstanding during the registration of FIR against the accused and she has no objection if the bail is granted to Tahir Shah. On her statement, the concerned court granted bail to Tahir.
LHC Justice Sayyed Mazahar Ali Akbar Naqvi issued a notice to the concerned Gujranwala police officials and summoned the case record.
Case details reveal that Javed Iqbal had solemnized second marriage with Tasneem Akhtar and then divorced her. After few months of the divorce, Javed passed away.
Tasneem thought no one knew about the divorce so she went to the office of the union council to get the divorce record altered to obtain property and other benefits.
When the brother of Javed, Orangzeb, came to know about the efforts of Tasneem, he visited the union council office and demanded the divorce record. UC Secretary Tahir Shah abstained from presenting the record to him.
Prosecutor fails to submit charge sheet ‘under political influence’
After being snubbed by the official, the doors of anti-corruption office were knocked and FIR was registered against Tahir and Tasneem as accused and co-accused respectively.
During the investigation, the allegations of the petitioner were found correct and record tampering on the direction of the co-accused was proved.
Orangzeb, in his petition filed in the LHC, sought cancellation of Tahir Shah’s bail and contended in court that the divorce record was altered to ascertain benefits to the co-accused woman.
Police officials were also found guilty of misusing powers as they had switched the name of the petitioner with that of the co-accused against the norms of justice.
He prayed the court to set aside the passed bail order and take strict action against those responsible, marking the investigation to the senior officials.
