IHC disposes of contempt proceedings against CDA chief

Chairman appears before court, submits unconditional apology over erroneous advertisement

ISLAMABAD:
Islamabad High Court (IHC) disposed of the contempt petition against the CDA chairman after an unconditional apology in the case pertaining to erroneous advertisement regarding allotment of plots.

The case was presided over by Justice Amir Farooq on Tuesday in which Capital Development Authority (CDA) Chairman Amir Ali Ahmed appeared before the court.

Earlier, CDA had published the advertisement in the newspapers stating that the allotment process had begun following directions of IHC even though the authority’s representative had sought a three-week period from the court as the process was underway.

In a previous hearing, the counsel representing CDA had pointed out that “the advertisement has been created to initiate the process of balloting for allotment of plots to the petitioner, but bare perusal of the advertisement shows that it has given pursuant to an order passed by the court on October 10.”

However, the court had observed “This court never passed the order directing CDA to initiate the process rather the CDA chairman made a statement that the process of allotment of plots in lieu of land is under process, and CDA sought three weeks-time from the court in this regard.”


The court asked the CDA chairman which directions from IHC they had followed in issuing the advertisement to which Ahmed replied that the court had issued no such orders that were advertised in the newspapers.

Justice Farooq remarked that instead of dumping the matter on the court, CDA should abide by its responsibility and added that he had been serving in IHC for five years and knew that it was done deliberately.

The CDA chairman replied that he was ready to take responsibility of the mistake committed by whosoever and assured the court that he would personally probe into the matter.

At this, the court disposed of the case with directions to CDA chairman for publishing a new advertisement without IHC’s name in it.
