IHC reconstitutes bench to hear Sharifs’ plea

ISLAMABAD:
The Islamabad High Court (IHC) on Monday constituted another division bench to hear petitions seeking suspension of the sentences awarded to the members of the Sharif family in the Avenfield Apartments’ reference, making it the third in less than a month.
The newly formed bench comprising Justice Athar Minallah and Justice Miangul Hassan Aurangzeb would take up the matter as Justice Aamer Farooq, who was a part of the previous bench, has left for summer vacations.
The court would hear petitions of ex-prime minister Nawaz Sharif, his daughter Maryam Nawaz and son-in-law Captain (retd) Safdar against suspension of sentences.
In July, Justice Mohsin Akhtar Kayani availed summer vacations after hearing Sharif family’s appeals against judgment of the accountability court, petitions seeking suspension of the sentences and a transfer application requesting IHC to transfer pending references to another accountability court.

Despite his availability, IHC’s Justice Shaukat Aziz Siddiqui has not been made a part of any bench while Justice Aurangzeb has been a member of all three consecutive benches since the petitions have been filed.
Moreover, Justice Farooq and Justice Aurangzeb had allowed Sharif’s petition and transferred Al-Azizia, Hill Metal and Flagship, and other company’s references to accountability court judge Muhammad Arshad Malik from judge Muhammad Bashir, who pronounced judgment in the Avenfield reference.
On July 6, judge Bashir convicted Sharif, Maryam and Safdar, and awarded sentences of 10 years, seven years and two years, respectively, while imposing heavy fine on father and daughter.
