Construction delayed: Construction company issued notice

A consumer court issued notice on Tuesday to the Tricon Developers’ chief executive officer and services manager for June 9 in a petition seeking payment of Rs15,375,000 for delay in construction of a house.


The petitioner, Malik Faiz Rasool, said that he had purchased an 8-marla constructed house (House No 57-C) on June 7, 2010, at the Tricon Village against full payment of Rs5,000,000. He said under the conditions of the contract, he was promised possession of the house in February, 2011.

The petitioner said that he had remained in contact with the company’s sales and marketing general manager, Naveed Ahmad, who had assured him that he will be handed over the possession of the house in February. He said when he sought Ahmad in February, he found out that he had resigned from the company.

He said instead he received a call from Saifullah, the services manager, who informed him that he will be given the possession of the house in September 2011.

He told the court that he had told Saifullah that he could not wait till September as he had to shift his family to Lahore from Multan and had nowhere to stay. He said he had made the shifting arrangements in view of the date mentioned in the contract.

He asked the court to direct the company’s chief executive officer and the services manager to pay him Rs15,375,000 as damages for mental torture, embarrassment, lawyer’s fees and travelling expenditures.

Saifullah told The Express Tribune that the company was concerned about the delay but a delay did not mean that the petitioner will not get the house. He said the company was ready to pay him a penalty under the contract.

He said that the company was trying its best to deliver the completed house by July 2011, before which he said it would not be possible.
