The Supreme Court on Monday accepted to the hear the plea regarding the non-formation of the Election Commission of Pakistan (ECP).
Chief Justice Iftikhar Mohammad Chaudhry will be heading the bench hearing the petition.
The apex court observed that the election commission has not been functional since the passing of the 18th amendment.
Chaudhry said that the government needs to form a new election body immediately and abide by the constitution.
The chief justice had earlier observed that the non-formation of the election commission had been resulting in complications in electoral affairs. The issue was brought to the attention of the apex court when an electoral dispute in South Waziristan was brought to the Supreme Court since the election commission had not been constituted in accordance with the 18th amendment till then.
