LHC seeks solid arguments over petition against judge
Justice Farrukh Irfan Khan of the LHC should be stopped from functioning as a judge for having offshore companies.
LAHORE:
Lahore High Court Chief Justice Syed Mansoor Ali Shah on Friday sought more arguments over the maintainability of a petition seeking directions to stop a judge from judicial work till his name is cleared from the Panama leaks.
The CJ adjourned further hearing till May 29, asking the counsel for the petitioner to come prepared with arguments over maintainability.
Petitioner Gulzar Ahmed submitted that Justice Farrukh Irfan Khan of the LHC should be stopped from functioning as a judge for having offshore companies. He asked that the judge be restrained from performing duties till the matter is cleared.
Challenging Disqualification: LHC restores reserve seat members
The CJ, during proceedings, remarked that the Supreme Judicial Council is the competent forum for proceedings against judges of the superior judiciary. “A judge cannot be stopped from functioning through a writ petition,” he said.
After the media hype over the issue, M Yawar Irfan Khan, brother of Justice Khan, tried to clear the latter’s position by sending a statement to the media. He said owning to his brother’s position as a judge of the Lahore High Court, it is not possible for him to respond to the orchestrated campaign against him. Khan added the purpose was is to malign him and the judiciary.
“Considering that his silence has been taken in a wrong way, the Irfan family feels it necessary, at this stage, to highlight the actual facts. As a lawyer and professional working, inter-alia, in the field of Intellectual Property law, Justice Farrukh Irfan Khan acquired an impeccable reputation.”
