Court stays commercial use of house

Islamabad Civil Judge Nadeem Anjum Mian on Saturday granted a stay till April 4 on a petition filed by area residents against the non-residential use of a house in their street.


Eight residents of Street 28, F 10/1, asked the court to stop a homeowner in the street from renting out his property for non-residential use, noting that it was bound to create a great deal of problems for women, children and other residents, as well as raise security concerns.


Advocate Tauheedur Rehman contended on behalf of the residents that under Islamabad’s zoning code, “no land or building shall be put to non-conforming use,”. The rental of a house for commercial use is in violation of the code, he said.

Viqar ul Haq | 13 years ago | Reply Commercial use of residential buildings has greatly marred the tranquility of Islamabad. Schools have proliferated all over the city, causing great pressure on residents during morning and afternoon timings. There is a mushroom growth of coaching centres where a host of cars are parked making the evening stroll of residents absolutely impossible, besides parking of guest cars. The court must restrain scrupulous people from using residential houses for commercial uses, especially schools. The main Nazimuddin Road and some other internal roads get clogged due to heavy rush of cars coming to drop or pick the kids studying in these schools. CDA is complacent and political and VIP pressure allows blatant use of such unethical practices. The CDA had allotted plots for constructing educational institutions to the owners of schools in the city areas on special concessional rates, but none of these schools has moved to those areas as these are too far off. CDA and the school administrations must find a way out to lessen the traffic rush by making one way traffic zones in certain areas to allow smooth flow of public traffic.
