Seniority restored: Transfers, posting orders of NCHD set aside
The court observed that NCHD made certain promotions in a manner which were against the law

The IHC on Friday set aside orders of several posting and transfers of the National Commission for Human Development (NCHD) and restored seniority of its employees.
Justice Noorul Haq N Qureshi observed that the NCHD administration had made certain promotions as well as posting and transfers in a manner which were against the law and corum non judice. The remarks in the judgment came while deciding petition filed by NCHD employees.
Counsel for the petitioners, Raja Saifur Rehman, argued that the NCHD administration was not happy with petitioners and they posted juniors on senior positions which empowered them to transfer or even terminate seniors.
NCHD’s counsel, though, defended the promotions as well as transfers of certain officers. The court, however, observed that out of turn promotions and unnecessary postings and transfers may cause complications and consequently hamper smooth functioning of the organisation.
The court set aside the transfer orders and directed NCHD to act in accordance with law.
