Judges’ appointment: IHC orders registrar to bring in records

ISLAMABAD:
The Islamabad High Court on Wednesday ordered the registrar of the court to submit records related to the appointment of judges in the subordinate judiciary of the capital.

Justice Aamer Farooq, directed the registrar to submit the record within a week.

The Islamabad High Court Bar Association, District Bar Association, and Advocate Muhammad Waqas Malik had filed identical petitions in 2012 while citing 18 judges of the district courts and the IHC registrar as respondents.

The petitions said that the IHC administration did not follow the Judicial Services Rules, 2011. They added that 50 per cent quota of Islamabad was completely neglected while making the appointments.


“The appointments of judicial officers in Islamabad were made in violation of the quota reserved for the provinces as well as for Islamabad,” the petitioners stated.

On the other hand, the judges of subordinate judiciary informed the court that the administrative order of the high court could not be revisited on these petitions.

“There is no express provision in the IHC Act, or in Islamabad Judicial Service Rules, where an administrative order regarding employment, induction or absorption can be revisited at a subsequent stage, and that too at the instance of a stranger, whose only intentions is to malign the judicial officers.”
