Extradition: Dubai court rejects Sophia Mirza’s appeal

Mirza had challenged the ban in the Dubai appeal court but her plea was rejected.

LAHORE: A three-member appeal court of Dubai has restrained the UAE government from handing over a Pakistani national, Omar Farooq, former husband of actress Sophia Mirza to the Pakistan government.

The Lahore High Court on October 14, 2009 had issued red warrants against Farooq and the Supreme Court (SC) of Pakistan had directed the Ministry of Foreign Affairs to approach the UAE government to trace the two children of Farooq and Mirza on a petition filed by Mirza.

The Dubai court in its decision announced on February 13 said, “It is not possible to extradite Omar Farooq to the authorities concerned in the Islamic Republic of Pakistan.” The court also imposed a ban on the travel of the twin daughters of the couple to Pakistan.

Mirza had challenged the ban in the Dubai appeal court but her plea was rejected.

A three-member bench of the SC was inquiring how Farooq had escaped from the country along with the two children despite their names being placed on the Exit Control List (ECL). Chief Justice Iftikhar Muhammad Chaudhry had directed the interior secretary to cancel Farooq’s passport and the Federal Investigation Agency to look into the matter while consulting with the Foreign Office.

He had also observed that if Farooq appeared before the court voluntarily, he would be given full protection.

There was litigation between Mirza and Farooq over the custody of their two daughters.
