LG&RD dept: Notification issued for implementation of amendments
Changes to ensure transparency in running LG business
PESHAWAR:
The Khyber-Pakhtunkhwa Local Government, Elections and Rural Development Department notified the recent amendments made in K-P Local Government (LG) Act, 2013 and asked the relevant departments concerned to start their implementation. The amendments had been approved and passed by the K-P Assembly in July.

One of the notifications issued in this regard, a copy of which is available with The Express Tribune, stated the tehsil council has been empowered to conduct fact-finding enquiry against the employees of Tehsil Municipal Administration.
It read after the enquiry, the case should be recommended to the Local Council Board of the LG department for proceedings under Efficiency and Discipline Rules of K-P.
In another notification issued by LG department, a copy of which is also available with The Express Tribune, ‘Pre-monitoring Mechanism’ for posting and transfers of employees in LG offices will be initiated. The notification stated monthly or fortnightly transfer/posting proposals of employees will be prepared by the district head in light of appointments, promotions and transfers (APT) rules and policy and criteria for information of the district nazim.
The nazim may point out anomalies in light of APT rules before issuance of orders within a week, the notification read, adding, in case of no response by the nazim within seven days, it should be considered that the nazim has no comments or recommendations to offer.
The notification added, in case of violations of APT rules in transfers and posting, the case will be referred to the administrative secretary of the department concerned who will be considered as the final authority.
“There should be no discretionary posting or transfers of employees but it shall only be upon enquiry or tenure under APT rules and it will be mandatory for all devolved departments to submit a copy of appointment, promotion and transfer orders to the district nazim,” it read.
The document added it will be mandatory for heads of all devolved departments in the district to attend meetings of the district government about which they will be informed at least a week prior to the moot being held.
In case of non-compliance, the nazim may lodge complaints with the divisional commissioner and administrative secretary who will take action against the defaulter. “A copy of whatever action is taken will be sent to the nazim within 30 days,” the notification read.
An official of the LG department privy to the development told The Express Tribune all the notifications have been issued after amendments were made in K-P Local Government Act, 2013.
The official said after consultations and deliberations, representatives of the three tiers of the LG were notified about the implementation of amendments. “These [amendments] were recommended by district, tehsil, and village councils which the Cabinet approved,” he said, adding, they are to be implemented for running the business of LG in a transparent manner.
