The appointment of Ashraf Jahan Jamali, the wife of Chief Justice of Pakistan Anwar Zaheer Jamali, as a Federal Shariat Court (FSC) judge has been challenged in Lahore High Court.
Advocate Iqbal Haider, Advocate Fawad Masood and Advocate Sheikh Nasir said rules and seniority of sessions judges had been ignored in 2013 when Ashraf Jahan Jamali (a district and sessions judge) was appointed a Sindh High Court additional judge. After some months, they said, she was transferred to the FSC without approval of the parliamentary committee on judges’ appointment. They said that on September 1, 2014, the president had extended for a year Justice Jamali’s tenure as additional SHC judge while she was working as an FSC judge. In Oct 2014, they said, she was repatriated to the SHC as an additional judge. She was confirmed as a high court judge on August 26, 2015. She was again appointed an FSC judge on August 28, 2015, in violation of Article 203 of the Constitution, the petitioners said. They requested the court to set aside the appointment.
