Wronging a widow: PHC seeks reply from defence ministry
Petitioner’s counsel says security forces were receiving income being generated from widow’s property

The Peshawar High Court sought a reply from the Ministry of Defence after a widow claimed her property was taken by security forces, that were generating an income through it.
The bench, headed by PHC Chief Justice Mazhar Alam Khan Miankhel, was hearing a petition filed by Zahida Bibi through her lawyer Bashir Wazir on Wednesday.
Wazir told the court the petitioner’s husband Daulat Shah and son Shujat Shah were picked up by security forces from Kabal area of Swat district.
He said security forces accused Daulat and his son of carrying out attacks on security forces and both were kept at an internment centre where her husband died, while her son was placed in the black category.

He maintained a 22-kanal property, a house and a tractor were also confiscated by security forces. The petitioner’s counsel argued the agricultural land and tractor were given to people on lease.
Wazir said security forces were receiving the income being generated from the property, while the petitioner, the only remaining heir, was left to struggle financially. The chief justice inquired from the petitioner’s counsel whether the property was attached. The lawyer replied the property was not attached.
The chief justice ordered the deputy attorney general to file a comprehensive reply within 14 days. The bench adjourned the case till July 14.
