Modaraba case: AC prevented from hearing corruption reference

The Peshawar High Court has stopped an accountability court from hearing a corruption reference filed against a couple arrested by National Accountability Bureau (NAB) K-P in a modaraba scam.



A division bench, headed by Justice Qaiser Rasheed, heard a writ petition filed by Iftikhar Hussain and his wife, Neelam Pari, through their counsel, Aminur Rahman.


The bench was informed the petitioners were arrested in a modaraba case. The couple was subsequently released on bail.


Rahman said the case was under trial at an accountability court. According to the counsel, this was not a modaraba case but a monetary dispute between the petitioners and a group of women. He said a civil suit regarding this dispute was also under trial at a local court in Mardan district and, as per the law, NAB has no authority to arrest anyone in private monetary disputes.
