Unique Zari served notice for non-delivery

Petitioner says she underwent mental torture and wants Rs1m damages.

LAHORE: A consumer court on Wednesday issued a notice to the owner of a stitching and embroidery shop, Unique Zari, for February 11 in a suit seeking Rs1 million damages for alleged non-delivery of two dresses.

Petitioner Naseem Mehboob submitted that she gave H Arshad, owner of Unique Zari located in Liberty Market, two suits to stitch on October 28, 2010. She said that she paid Rs7,500 as advance against the total fee of Rs16,000. The delivery date was set for November 15, 2010 at which time the remaining amount was to be paid, she added.

She told the court that both dresses were to be worn on a henna ceremony on November 25, 2010. She said the respondent had been confident that the delivery date would be met. As the date of delivery came closer, Mehboob said, she telephoned the owner and paid visits to the shop reminding him of his commitment. The respondent, however, failed to meet the delivery date and in fact did not even deliver the dresses on the day of the ceremony, she said.

The petitioner said she suffered mental torture due to the respondent’s breach of commitment. She said her legal counsel had served a notice on the owner to settle the matter but the respondent had ignored it.

She requested the court to rule a breach of contract and direct H Arshad to pay her Rs1 million. The judge issued notice to H Arshad for February 11.

H Arshad, speaking with The Express Tribune, denied that both the dresses had not been completed on time. He said he had told Mehboob that her order was ready but she had not collected it. He said her allegations were not based on facts. He said he might have been late a day or two because of the power load shedding.
