Custodial fights: PHC orders IGP to reunite son with mother

Peshawar High Court directed IGP Nasir Khan Durrani on Tuesday to produce a seven-year-old boy and hand him over to his mother, a Kyrgyz national.



The divisional bench, comprising Justice Yahya Afridi and Justice Roohul Amin Chamkani, heard an application filed by Dr Ayija through her lawyer Muhammad Abdullah. The bench was informed that Ayija married a resident of Swabi in 2005 and had three sons. They had differences over some issues and her husband Muhammad Zeb took her sons away without notifying her.


Abdullah said Islamabad High Court ruled in favour of the application and ordered Zeb to return the children to their mother. He argued two sons were reunited with Ayija. However, the third, Muhammad Yousuf, was still with his father who is nowhere to be found.


He argued Muhammad Yousaf was a Kyrgyz national and as per law, should be placed in the custody of her mother.
