Heinous crime: LHC upholds life term in incest case
The man had been accused of raping his daughter by his family
LAHORE:
Lahore High Court on Wednesday upheld life imprisonment of a man accused of raping his daughter.
Dismissing the appeal of accused Khurshid, Justice Hafiz Shahid Nadeem Kahloon stated that persons who tried to undermine the dignity of close relations should not be spared.
Khurshid had filed the appeal against his 25 years rigorous imprisonment and a fine of Rs100,000 imposed by an additional district judge on December 2, 2009.
In her complaint before the police, the victim had stated that she used to live with her parents at a village in Dera Ghazi Khan.
She said that the accused raped her and told her not to tell anybody about it. When she finally told her mother about it and she confronted him, he beat her up.
When the neighbours learnt about it, the family left the village and took up residence in Dera Ghazi Khan city.
However, her father continued to rape her until her mother informed her family.
The prosecution presented 10 witnesses in the case.
The medical examination, too, confirmed the rape.
Appearing before the LHC, counsel for the appellant said that the statement of the alleged victim had been influenced by her mother and other relatives, who were hostile to him. He said that the appellant was not guilty.
The additional prosecutor general told the court that the prosecution had proved its case beyond any doubt.
He said the complainant and her mother had no enmity with him. He said the findings of a medical examination had supported the victim’s story.
He said that the accused deserved no leniency.
