Jurisdiction issues: Maintainability of Moazzam Ali Khan petition questioned

The Sindh High Court (SHC) questioned on Wednesday the maintainability of a petition seeking direction for the Federal Investigation Agency (FIA) authorities to allow Moazzam Ali Khan, the financer of the killers of Dr Imran Farooq, to meet his family members.


"Since the case is filed in Islamabad the counsel for the petitioner may satisfy this court on the maintainability of the petition for hearing [here]," remarked a division bench, headed by Justice Naimatullah Phulpoto.


Saadia Bano, Khan's wife, had moved the high court against the FIA and interior ministry authorities for not allowing her to meet her husband. The judges observed that since the case against the petitioner's husband was lodged in Islamabad, her petition could not be heard by the SHC. Adjourning the hearing, they asked the petitioner's lawyer to make arguments on the point of maintainability on the next date of the hearing.
