He also stated before the three judge bench, headed by Justice Faisal Arab that all the documents have been provided to defence team related to the Federal Investigation Agency (FIA) inquiry.
Referring to the statement of then Cabinet Secretary Masood Alam Rizvi to FIA JIT, Sheikh contended that no summary was sent by the premier to the president regarding the promulgation of emergency on November 3, 2007.
The counsel also claimed that the issue about the promulgation of emergency and PCO was discussed in the cabinet meeting first time on November 6, 2007, adding that though it was not the part of agenda but it was discussed additionally as then senior advisor to PM on law affairs had briefed the cabinet members about the promulgation of emergency.
Sheikh also stated that whenever the court feels about the furnishing of any document related to November 3, 2007 emergency than it might summon from relevant department.
He said defence counsels demand to provide them certified copies of the documents is not appropriate as under Section 87 of Evidence Act they could get the attested copies of public documents themselves. They could also get the copy of the resolution from the Parliament Secretariat as under the tri-cotomy rule Parliament is independent and not under the executive authority, he added.
After hearing the arguments of the head of prosecution team, the court reserved the judgment on providing additional documents to the defence team.
The decision would be announced on June 13.
Earlier, defence had team filed an application for additional documents including minutes of the 44th session of the National Assembly dated November 7, 2007, list of the then cabinet members, including advisors and attorney general for Pakistan, governors, chief ministers, chief secretaries, home secretaries, inspector generals of police, members of the cabinet and provincial assemblies of all the four provinces, and the copy of the notification that replaced Musharraf with Kayani as COAS and the letter written by then PM Shaukat Aziz to the then president before emergency. They also demanded the lists of all those persons visited Musharraf in the President House and the Army House Rawalpindi from 1st July 2007 to 3rd November 2007.
The Express Tribune has learnt that Musharraf’s counsel will move another fresh plea, seeking additional documents related to November 3, 2007 emergency and PCO very soon.

Alarm Sheik is presenting argument from the government on false statement by people who consulted President Musharraf. The inquiry committee did not perform its duty. Federal Investigative Agency is Federal Police but the manner of investigation was a joke. FIA acted more in tune as a Security Guard than a Investigatory Agency.
