The new amendments stated both the bride and bridegroom had to undergo a medical checkup.
The Punjab Government on Friday decided to withdraw the notification regarding the amendments to be made to the Nikah nama law.
The withdrawal comes after objections from the provincial Law and Home department. The objection questions the approval of the amendments without consultation of the said departments.
According to Express 24/7 Reporter Rabia Mehmood, the law department will now ask the Local Government and Community Development on how the notification was issued without approval, and will work with the department on the amendments. The Punjab government might take out some of the amendments as well.
The Punjab Government made eight amendments to the Nikah nama Law on Thursday. A circular was issued by the Local Government and Community Development Department and sent to all DCOs in Punjab, describing the Punjab specific amendments. The new amendments make it necessary for both the bride and bridegroom to undergo a blood test, which is made compulsory to prevent disabled and handicapped births.

Don’t know about the current one,but this document required the approval & signature of the parents.Rightly,better sense has prevailed,we’ve had enough of parents forcing their decisions,opinions on their children.We have to get out of this mentality of master & slave,the slave beholden to the permission & approval of the master.Recommend

It is a good decision helpful to minimize the comlications of marriages and stop illegal marriages registration.Government should also manage a scale for the nikah registrars and feeses schedules of them.Recommend

Thats just shows how dumb these politicians and law makers are, surely it looks like an upset daddy’s decision to take revenge from the whole nation’s children. LOL
I am glade that Punjab Govt has taken this clause back other wise it would be a trouble for themselves to get third or fourth wife. :)
Last I checked Islam allowed me to marry my choice of woman and also allowed woman to marry me with her choice, my marriage to my wife would celebrate Islamic laws.
Not to mention these kind of laws are against the constitution of Pakistan any way.
@Ayesha you don’t need to worry about the whole nations next generation, no one checked in Australia what blood group and medical issues people of Australia had in past when people get married and surely them people are way ahead in life style and resources then Pakistan.
Marriage is a basic human right and a natural act of human being, no one will impose conditions on me when and how to get married when my ALLAH and his Prophet has made it simple for me. Marriage is a part of a religion other not part of customs. Religion made it simple and thats how I will follow so I refrain from ZINA and HARAM and be able to marry my GF.

@Mohammad Syed: Iran is a muslim country, they have made it mandatory, so is Saudia Arabia, they are getting rid of Thalassemia by 2011 inshaAllah, last I knew Saudia was MOST ISLAMIC country in the world, and we call ourself heh.. okay buddy I give up.. @Ayesha Read above for your own information. Instead of getting personal and offensive try to understand that in our country Pakistan its just not controllable. Talking about Saudi, Saudis have unlimited amount of money and they can control corruption in their own country, they can produce mass amount of hospital and hire medical staff. Saudi also pays their own citizens unemployment benefits and pays mothers money to look after their kids. There is no competition between Saudi and Pakistan in terms of resources and money and implementation of the system.
Iranians, try marrying an Iranian and leave country with out his consent.
Again iran has massive amount of money produced from Oil Trade they can implement what ever they like,
What do you have, poorty, ignorance, missing out of basic health neads, missing out on even on a clean water for crying out loud,
You cant even implement a basic school for Girls in Rural Areas of Pakistan, let alone a complete medical check,
There is a way to introduction and implementation of the system, its not 1800 Mughal Kingship that what ever you like you can impose it on the citizen of Pakistan, Pakistan is a republic country and there is a constitution, you have to respect the constitution of Pakistan, you cant just create and impose a self made Law which is in contradiction of the constitution of the state. May be you should consult with some lawyer and try to understand the definition of the “LAW” and “Ordinance”
This is a Legal Matter not a emotional decision of some one who has power can just do what ever he likes. If it is approved and implemented then it can be used as an example for other state of Pakistan and we may get away from the situation for being a citizen of Metropolitan City of Lahore or Karachi or Islamabad, but you need to think our side your box, there are many more people living in rural areas who cant even read and write and this law can be abused to remove the basic right of the woman and they will be forced to marry “with law” to people whom they will never agree in normal time.
Medical Certificate is a good thing no doubt about it, I am sure and agreed there should be blood test before marriage for HIV and other major illnesses, but making it legal to have it? what back ground work has been done to prevent corruption in terms of having medical certifications done, you cant get a basic medical help and you are trying to put people of Pakistan in to forced medical certification to get married.
So what if some has a minor medical condition, who is govt to decide whether they should get married or not. imagine your own daughter born with an inactive Hep B virus in her body which will never harm her and if her husband have vaccination he will be save as well but he has to get the vaccination booster done every 3 years. Now imagine trying to explain this in FATA or Rural Punjab areas where most people already have Hep b and C. Are you not killing her chance to get married and live a normal life? don’t you think if this woman is not married then how soon she will go insane. If he / she is not married then are you not forcing him or her to commit zina, marriage is a basic need of a man and woman.
How old a person has to be to think and discuss before implementation of the law. There is an educated way to do it then just dump it on us.
and we call it EDUCATING the NATION before imposing it on them.

@Mohammad Syed: I am into Thalassemia awareness since more than 6 years, I along with my two brothers suffered Thalassemia Major disease state, I know majority doesn’t even know what is Thalassemia, but you can’t neglect the amount of people having Thalassemia, as carrier state and as disease state, can you ignore the 5 thousand kids born every year with the disease?
If you talk about money issue then I tell you simple way to overcome, there are multiple hospitals I know who are doing Thalassemia screening for free, even we have arranged the facility twice and inshaAllah in future we gonna continue it.
About Hep and HIV, if you donate blood you know they test you for Hep, HIV, Typhoid for FREE, hows the deal?
By imposing the law we can educate them, can’t we? I am doing my part, when will you? buddy don’t just denounce it completely, which ever clause is negotiable can be told properly?Recommend
