Mastishhk | 13 years ago | Reply @Manish....Adnan Sami purchased property in Mumbai fully knowing the fact that his application for obtaining Indian Citizenship had not been accepted. Before investing his money in property he should have shown some wisdom by obtaining legal opinion. Even if he was conned into buying this property the onus still lies on Adnan. If someone made him believe that he could get away with this owing to his celebrity status, its Adnan Sami's fault. Its his money that was at stake. If his being a Pakistani was an issue with India, he would never have been allowed to stay in India for so long. I do advocate that he should be given Indian citizenship, but unless that happens, he cannot purchase property in India. There are many Pakistani artists in india practicing their craft and have large fan followings irrespective of the religion they follow or the country of their origin, but law is still same for anyone.

You are asking about obtaining the little identities like driving license, cooking gas connection, electricity bills, Phone bills, professional identity card and even voter ID card, which are issued to the common man without asking him to prove his/her nationality? In fact, these little identities prove your nationality! Do you really think that these trivial identities are very difficult obtain, particularly in the sub-continent? It is estimated that there are almost 15 million illegal Bangladeshi immigrants living in India and everyone of them do posses this or that kind of identity that declares themselves as an Indian citizen. All I am trying to tell you is that Adnan was not a victim but, he consciously violated the law. But, having said that I am furious at the government of India for not granting him the citizenship. If we can tolerate 15 million Bangladeshi parasites, then why not grant a citizenship to a man like Adnan Sami who brought India glamor and glory by his sheer talent? He wants to be an Indian citizen and he earned that right by contributing and enriching our Indian culture. We Indians must take a lesson from the US, a country which immensely benefited by the talented immigrants from around the world. The migrants made the US a great super power of the world. India may not be the America but it should be a welcoming home for all the talented artists, writers, poets, scientists and scholars from every mentionable field from at least the Sub-continent. India is great and will be greater with her magnanimity.

M.Sethi | 13 years ago | Reply @Neeraj, Thank for explaining the procedure for registering,which is a normal procedure in most country's.However,it is not acceptable that a property is transferred and registered without the personal particulars of the tranferee and for that it is imperative that a identification document be produced before the concerned authoritys official to complete all legal and relevent formailties.If you expect us to believe that the I assure you it is highly indisgetable! Another thing which comes to my mind is that possibly Adnan was conned into believeing that he was eligible to enter these sale by his propetry advisor/Estate agent and sellers/owner.After all they were Indians and well informed of the transaction being concluded with a non-Indian?. No one is blaming the Indian government or their law of the land,but what is to be considered is that possibly due to ignorance or due to some con act Adnan got conned?.

My guess that he brought 8 flats and 5 parking lots in mumbai despite the fact he is not the citizen of this country. The law is until and unless you are a citizen India you cannot buy any immovable asset. So isn't this a nationality issue???.

Theres no India-Pakistan angle involved here. Mr Sami hasn't been kicked out of his Residence but has been given 45 days time to explain his position. And he won't lose the money he earned in India as he would be let off with a nominal fine. He can still stay in India and practice his craft. If at all Mr Sami has been treated badly in India, it was by his Pakistani ex-wife.

Currently, no foreigner is allowed to buy properties in India. Western countries are insisting on government of India to open it's real estate sector to the foreigners, but the government has so far declined to do so. Property prices are appreciating rapidly in India and govt. fears that if it opens this sector to foreigners, billions of dollars would flood the real estate sector, thereby further increasing the prices. Once prices go up a foreigner would naturally be tempted to sell it and take the huge profits home. As I said in my earlier post, despite the above policy of govt. of India, there is a provision in the law that allows a foreigner to buy property in India, but with certain conditions like: He/she should provide valid reasons for buying the property, property should not be sold without govt. permission, foreign owner should not lease his/her property etc. It must be clear now that the singer did violated the law. @M.Sethi, Adnan Sami while defending his decision to buy properties has stated that he was not aware of the rejection of his application for Indian citizenship. If Adnan Sami is unaware of his citizenship status then how do you expect a registrar of properties to be aware of the singer's status. Let me tell you that, in India, Registrar of Properties does not check the nationality of the buyer. His duty is limited to see if the property on sale is rightfully belongs to the seller and check whether it is mortgaged with any Bank. If it is clear, then, he collects the relevant taxes and approves the sale deed. The buyer just has to provide name, father's name, date of birth, residential address and profession. After that it is the duty of the buyer to inform various taxation departments about the purchase of the property where he/she not only has to reveal their identity(PAN card,Voter ID, Birth Certificate etc.) but also prove that he/she bought the property with legally earned money (tax paid). If someone fails do so, then the purchased property stays illegal. If discovered, this property is liable to confiscation. Anyway, a little celebrity like Adnan cannot be an enemy of mighty Indian government. If govt. indeed wants to punish him then all it has do is to cancel his visa and kick him out of the country.

Contrary to media reports stating that Adnan Sami's property has been confiscated and sealed by the Enforcement Department, Adnan Sami in his Oberoi Sky Garden residence at Lokhandwala said that he is still allowed to stay at his place. Said Adnan, "This decision is of a tribunal court. Many have this misconception that the property is immediately confiscated from me. That is not correct. We have been given 45 days to appeal and we will appeal. There are many legal factors and we will address them in the court of law."

So that should happen to a bhagoora. But it is a fact that any govt. can twist rules to do what it must. For instance, there are thousands of Indians who are land grabbers but they firmly remain out of bad news because no Indian police walla ever snatches their property. Same is the case with Pakistan and Russia and many other countries. Bad luck to you, Sami. Even if you have 8 properties in India you can't be sure of full time sukoon in life.

The law in India is that a foreign national, without the permission of the “The Reserve Bank of India” can not purchase an immovable property (for more details you may refer to the link below: http://www.rbi.org.in/scripts/faqview.aspx?id=33, then how come this took place in the first place? The news mentioning Pakistani is misleading, this applies to any foreign national. Also, if you apply to RBI and give appropriate justification, you are most likely to get permission too, we should request ET to replace Pakistani by “any foreign national” , but the question arises, if such was the case then how come such illegal purchase/sale could take place? Since I had a similar experience in Mumbai back in 1995-96 being a Pakistani film artist, (as besides TV I had acted in several Lollywood films and sung for them hence registered with Pakistani Film association) BUT I was stopped before going into contractual obligations to sing for several Hindi Films. I had basically gone with (late) director Iqbal Yusuf to complete songs for film RAAZ, composer Babul Bose, starring Mohsin Khan and Babara Sharif

In Pakistan If you buy a property or transfer it on your name the first thing one need to present is his/her national ID Card. At least his advisor or lawyers would have known and told him but Adnan Sami must have insisted despite the risks. As a Pakistani, I don't have much respect for Adnan Sami anyway. Now it looks like that there is nobody is above the law. Noto like when I used to live in Punjab and in those days nobody cared about law. People were framed of crimes, they did not do, and some were excuted wrongfully. I am an example, who had to leave the country (which I loved at that time) leaving the friends, family and assets behind only because a Govt. officer did not like me, because I did not do what he wanted me to do (break the law). I hope things get even better. Still there is much to be cleaned from all aspect of life. It is a shame that a most intelligent and honest prime minister India ever had, is in hot water these days. He is a Pakistani and must be proud of it to work in India as people of India do like the Singers of that class, because they love movies and classy singers and Sami was lucky to land in India but its unfortunate that he lost his hard earned wealth. He might come back to Pakistan after losing a lot of his wealth Not worth living in India when he is not happy with the punishment which he never expected or deserved. If you pay with your own money (i.e. not a loan from bank), you can buy any property in the UK or any other advanced country.

Neeraj, India | 13 years ago | Reply I am surprised at the comments here. You are blaming Indian government. The truth is Adnan Sami himself is guilty of violating the law. Foreigners can buy property in India, but, first they have to obtain permission from the concerned authorities. Registrar of properties cannot be blamed either, because passport is not required to transfer property rights from one person to another person, all you have to do is to pay the relevant taxes and property is registered in your name. If the buyer is a foreigner, then it is his/her job to produce the special permission to the Registrar and accordingly property rights are transferred in favor of the concerned foreigner. After buying properties an Indian citizen is required to file it's details with various taxation departments where he/she has to produce birth certificate/voting ID and other related documents to establishe his/her identity. If someone fails to do this then his/her property stays illegal and known in India as 'benami jaydad'. If discovered it is liable to confiscation. Clearly, Adnan's lawyers might have warned him about all this, but he chose to ignore it and bought the properties as an Indian citizen in total violation of the law of the land and paid the price.

GoP should request the Indian government to reutrn the propferty back to Addu, whereafter he should rent the same property to an appropriate client or sell it off to some letimate buyer. If Addu would like to remain in India due to professional reasons, he should do that, but Addu should live in a rented property rather than his own.

I was in Stockholm when they got married and came to see Arshad Sami(father) who was Amb. there in 1992/93. Come on Adnan there is nothing wrong being a Pakistani. Your father was a loyal Pakistani, a pilot who took part in 1965 or perhaps 1971 war against India.

(for more details you may refer to the link below. http://www.rbi.org.in/scripts/faqview.aspx?id=33 The news mentioning Pakistani is misleading, this applies to any foreign national. Also, if you apply to RBI and give appropriate justification, you are most likely to get permission too. I request ET to replace Pakistani by "any foreign national" ...

Well, I suppose there are several other and far bigger things that have embarrased Pakistan in the past and continues to do so neways. And my my, wots up with the Indian Govt. bashing? If thats the rule Adnan should have adhered to it irrespective of the agents who sold him the property knowing any such rule or this very matter coming to light after many years.

A Pakistani cannot buy property at all in India, especially in Mumbai. Neither can Indians her in Pakistan. I think they are following the law. He has numerous times denied being a Pakistani national. When these people get in trouble they look up to Pakistan for support. Same goes for an American Green card holder/ Citizen named Dr. Afia Siddiqui.

The Govt officials of Revenue department who registered that property on the name of Adnan, did they dont know that Rule? Indian mentality cannot change. I bet none in the world really cares about his/her country. Its just politicians in some countries who try to play with innocent citizen's emotions. What everybody really cares is all about him/her selves. If somebody really open his/her eyes. they can really understand it. Coming to Adana, he is really a excellent singer and artist. yeah rule is rule. Pakistanis and many other nationalities r not allowed to buy property in India. Now after so many scams and corruption in India. ED has suddenly waken up and trying to show that they r not dead.

Also,to all those claiming 'Apna mulk apna hee hota hai', I would say, get a life people. Had it not been for his quite successfull stint with the Indian Music Industry he wouldn't have even earned so much to have acquired all those properties, forget about the name/fame that he enjoys amongst the masses in India.

There were similar incidents involving hundreds of properties in Goa and elsewhere bought by westerners which had yo be sold back to Indians. Look very carefully At the laws of the land before buying property. Here in UK, there are many banks and mortgage societies which will not give a loan if you are not a permanent resident. Often this fact is hidden in the small print which some of us do not read carefully and get into trouble with later. Also, to be honest in the current climate of numerous terrorist attacks in the last 10 years funded or inspired by elements in Pak (Kargil, Parliament 2001, Akshardham temple, Mumbai stock exchange, Diwali blasts, Jaipur 2008, Mumbai- Kasab 2008 etc etc) are you surprised that we in India have to be extra vigilant. Raj | 13 years ago | Reply I remember once he met L.K. Advani for Indian Citizenship when BJP was in power. He was not granted citizenship. I am sure 25 million rupees is a small change for him. He would still be living in India because of the huge music market in India. Adnan is not alone, there are many Pakistanis singers who work in Bollywood and want the piece of the pie. To play in IPL is every Pakistani cricketers dream. When things do not go Pakistani way, the Pakistanis throw tantrums. Grow up.
