Custody battle: Mother’s custody petition dismissed

Justice James Joseph of Lahore High Court on Monday dismissed the petition of a woman seeking custody of her children.


In the order, the judge said the woman, who married a second time, had no right to custody of her children from a previous marriage.

Hammara Bibi had filed a habeas corpus petition seeking recovery of her two children – a seven-year-old son and a five-year-old daughter.

She said her former husband had been forcefully keep the children away from her and was not allowing her to meet them.

She said she was the natural guardian of the children and should be granted custody of the children.

She requested the court to depute a bailiff to recover the children and return them to her.

The father, in response, said that after divorce, the petitioner had married a second time and had no right to claim.

The judge accepted the contentions of the father and rejected the petition.
